Terms and Conditions of Sale
of Endless Shine LP

These terms and conditions of sale (“Conditions”) govern the sale of goods (“goods”) by you from the website of Endless Shine LP.
These terms and conditions constitute the entire agreement between Endless Shine LP and you - the Customer.
Please read these Conditions carefully before purchasing our goods. By ordering our goods, you signify your agreement to be bound by these terms and conditions.
1. Our Contract
- When you place an order with us to purchase goods, this constitutes an “Offer to Buy” from you. We will call you to confirm your order (“Order Confirmation”). At this stage the Contract between us will be formed.
- All orders are subject to our Terms and conditions of sale and we reserve the right to cancel or suspend your order based on these Conditions.
2. Price
- The prices payable for the goods as set out in the website, including the VAT and delivery costs.
3. Payment
- We'll send you an Invoice setting out the cost of your purchase. You can pay for the goods using a debit card, credit card.
4. Ownership and Title
- All title, ownership and risk of loss and/or damage to the goods purchased by you shall pass to you upon delivery of such goods to the courier.
5. Amendments to the Conditions
- We reserve the right to make changes to our policies, and these terms and conditions of sale at any time. You will be subject to the policies and terms and conditions of sale in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you).
- If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
6. Events Beyond our Reasonable Control
- We will not be held responsible for any delay or failure to comply with our obligations under these Conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your legal rights.
7. Waiver
- If you breach these Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions.
8. Governing Law and Jurisdiction
- Your relationship with us is governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the Courts of England and Wales.
9. Cancellation, Returns and Refunds Policy

In the event that you wish to cancel your order, you have the right to cancel the contract for the purchase of the item(s) at any time but not later than 14 days commencing from the date of receiving the goods.
- To cancel an order, written or oral confirmation must be made within these 14 days period. This applies to all of our goods.
- Any unopened items will be returned within 14 days of the date of delivery.
- We regret that no refunds will be given on goods that have been opened, or returned after 14 days from the date of delivery.
- Refunds will be processed once the returned items are received back. The amount we will refund is the amount paid for the product(s).

If any Goods you purchase is damaged, faulty or incorrect, we may offer an exchange or refund as appropriate, in accordance with your legal rights under the Consumer Rights Act (the “Act”).
Your legal rights under the Act include:
- Within 30 days of delivery of the Goods, you may exercise the right to a refund if the Goods purchased is not of satisfactory quality, fit for purpose or as described.
- After the 30-day period, but within six months of the date of delivery and where the Goods is faulty, you are entitled to a repair or replacement or where that is not possible, or the repair/ replacement does not resolve the fault, a refund.
- On expiry of the sixth month following the date of delivery, similar rights under the Act exist, but only if you can prove that the fault was present at the point of delivery.

To return or exchange Goods, you should:
- Completely fill out the return form with all the requested information
- Attach the Product
- Attach the Package
- Attach a copy of the Order form (description of the Order)
- Attach a copy of the Receipt
- Send to our address specified in the refusal form
- If the Goods are not delivered to you according to the Order, we have the right to refund on goods that have not been delivered to you. We will not be liable for any loss or damages suffered by you.
- We will refund you on the credit card or debit card used by you to pay.
- Our policy on cancellations, returns and refunds does not affect your statutory legal rights under the Consumer Contracts Regulations and Consumer Rights Act. If you have further questions regarding your legal rights, please contact us via email: info@endlessshinelp.com
10. Limitation of Liability
- Our liability to you for breaking any of these Terms and Conditions is limited to refunding any money you've already paid for items that you haven't received or that you've returned within the agreed timescales and in the required condition. We won't be liable for any other loss or damages, unless the loss or damages are caused by our negligence or our breach of these terms and conditions.
- We do not accept liability for any errors and omissions and reserve the right to change information, prices, offers, specifications and descriptions. We will endeavour to do our best to correct errors and omissions as soon as practicable after we become aware of them. We shall be under no obligation to dispatch an order for goods/offers which have been advertised incorrectly but we shall give you the option to either cancel the order or confirm the order at the correct price.
11. How we may use your personal information
We will only use your personal information as set out in our Privacy Policy.
12. Other important terms
- We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms. We will always notify you in writing or by posting on this webpage if this happens.
- You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
- This Contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
- Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
- If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
